Terms of Service

Acceptance
These Terms of Service (“Terms”) are an agreement between you and Pace Motorsport (“Pace,” “we,” “us”) governing your use of the Pace mobile app and racingpace.com (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
Eligibility and accounts
You must be at least the age of majority in your jurisdiction to create an account. Create only one account, for yourself, with accurate information, and keep it current. You’re responsible for keeping your sign-in secure and for everything that happens under your account.
The Service
Pace lets you capture session telemetry, record and livestream video, analyze your laps, and share sessions through a social feed. Features may change, and parts of the Service may be unavailable from time to time for maintenance or for reasons outside our control.
Your content
You keep ownership of the content you create. You grant us a non-exclusive, worldwide license to host, store, process, reproduce, and display your content as needed to operate and improve the Service — for example, to transcode and stream your video, compute your laps, and show your sessions to the people you’ve shared them with.
You’re responsible for your content. You represent that you have the rights to it, that it’s lawful, and that sharing it through the Service doesn’t violate anyone else’s rights.
Content about other people, including minors
If you post content about another person, or add them to a roster, you represent that you have any consent required to do so and won’t post content about someone who has objected.
If you add a minor as a roster driver or post media that includes a minor, you represent that you are the minor’s parent or legal guardian, or that you have obtained verifiable parental or guardian consent. You agree to remove that content if consent is withdrawn, and if you or a parent or guardian notifies us, we will remove it.
Acceptable use
You agree not to:
- harass, threaten, impersonate, or abuse others;
- post content that is unlawful, infringing, or that you don’t have the right to share;
- upload media of people who haven’t consented where consent is required;
- reverse engineer, scrape, or use bots or automated means to access the Service;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its data;
- use the Service for any unlawful purpose.
We provide tools to block, mute, and report, and we may remove content or suspend accounts that violate these Terms.
Recording, livestreaming, and event rules
You are solely responsible for complying with the rules of your track, club, and sanctioning body regarding cameras, recording, data logging, and live telemetry transmission. These rules differ by organization and event, and some prohibit in-car recording, live streaming, or transmitting telemetry during competition. Pace does not grant you permission to record, stream, or transmit where it is restricted, and using the Service does not override any applicable rule. Make sure you have the right to capture and share what you capture.
Telemetry and analysis
Telemetry, lap times, and analysis in Pace are derived from consumer sensors — such as a phone’s GPS and motion sensors, or third-party hardware — and are provided for informational purposes only. They may be inaccurate or incomplete and are not official timing, scoring, or measurement. Do not rely on them for any safety-critical, competitive-scoring, or regulatory purpose.
Intellectual property
The Service, including its software, design, and the Pace name and marks, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. These Terms don’t grant you any right to use our marks without our prior written permission.
Copyright complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to [CONTACT_EMAIL] that identifies the work, identifies the infringing material and where it is, includes your contact information, includes a statement that you have a good-faith belief the use isn’t authorized, and includes a statement — under penalty of perjury — that your notice is accurate and you’re authorized to act for the rights holder. We may remove material and, in appropriate cases, disable repeat infringers’ accounts.
Third-party services and app stores
The Service relies on third-party providers (for sign-in, video, maps, weather, analytics, notifications, and hosting), and your use of those features may also be subject to their terms. If you download the app from the Apple App Store or Google Play, your use is also subject to that store’s terms. The app stores are not responsible for the Service, and any claims about the Service are between you and us.
Availability and backups
We work to keep the Service available and your content safe, but Pace is not a backup service. Don’t rely on it as the only copy of anything important to you. We may modify, suspend, or discontinue parts of the Service, and we’re not liable for loss of content resulting from that.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or accurate.
Limitation of liability
To the fullest extent permitted by law, Pace will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100.
Indemnification
You agree to indemnify and hold Pace harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing anything, you agree to first contact us at [CONTACT_EMAIL] so we can try to resolve the issue informally. Any dispute not resolved that way will be brought in the state or federal courts located in California, and you consent to their jurisdiction.
Changes
We may update these Terms from time to time. If we make material changes, we’ll update the effective date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
